Most personal injury lawyers accept cases on a "contingent fee" basis. What is that?
A contingent fee agreement is a way of hiring a lawyer with no cost to you upfront. The lawyer only gets paid if he is successful on your behalf, and even then, you only pay him a percentage of what you get in the recovery on your case.
I am partly to blame for my injury accident. Do I have a case against the other guy?
Sure you have a case. Most states recognize the concept of "comparative negligence" meaning that the negligence of all the parties in an accident are weighed and damages are allocated based upon the fault of each party.
Why not wait a while after my accident before asking a lawyer about my injury claim?
It's generally a serious mistake to wait 'til the last minute to file a case. It becomes very difficult to find an attorney sometimes who's even willing to take your case. And getting close to a deadline can cause problems if there are technical issues relating to your filing.
If I have waited too long, will the statute of limitations prevent me from suing?
Every state has a different statute of limitations and every state may have a different statute of limitations for different types of cases. So, it is important as soon as possible to speak to an attorney who knows the laws of your state to find out what statute of limitation applies to your particular type of case.
When choosing which law firm to hire, what are the important qualifications to consider?
In looking for a lawyer to handle your case, you should look for qualifications based upon experience and certification, if possible, in the area of specialty you're looking for. You should look for lawyers who have shown by their time, their expertise, their involvement in the law, in the particular specialty they work in, and in their community, that they care about their clients, they care about the work they do, and that they've been successful in the work they do.
When a child or minor is hurt in an accident, who files a lawsuit on their behalf?
Normally, the parents will file on behalf of the minor, but anybody who is appointed as the legal guardian of a minor has the standing to file, in court, on behalf of that minor child.
If I'm not satisfied with my lawyer, can I switch to another firm mid-stream in a lawsuit?
It's my suggestion that you make all efforts to patch up whatever problems you have with that lawyer, including insisting upon a face-to-face appointment to iron out difficulties in communication. But if that does not work, you do have the right to switch attorneys. Your original attorney may have a lien on your case for his time involved, but you do have the right to let go a previous attorney and hire a new one.
